Whose fault would it be?

I was in the car with my mother and we were very close to the highway and there were traffic lights right before you reach the highway. Anyway, before mother could reach the traffic lights she came to an immediate halt, this old man literally hopped out of nowhere and was practically jay walking. But he was too busy looking at another direction before nearly getting hit by a Nissan Skyline. It was rather horrific, in fact it could be compared to the action movies with the real sound effects and all, I looked to my left the man's shoe came flying off and the next thing he was down. But 5 seconds afterwords he was up and again and all smiling. The guy in the Nissan asked if he was okay, and before anything else happened my mother drove off. Initially my heart was racing because I thought the man was dead, I heard a thump and he was down! I'm pretty sure the sign said 60km/h. I was wondering, if the guy in the Nissan had well, basically compressed and trampled over the man, whose fault would it be? The driver or the man (who was jaywalking in the middle of a very busy road)? Perhaps I've answered my own question, but I'm still wondering. I've read somewhere that the driver for the majority of the time is always held responsible?
